The transfer of Russian reserves from the Euroclear depository to certain pan-European structures would be a violation of international and contractual law. This was announced on November 4 by Dmitry Birichevsky, Director of the Department of Economic Cooperation of the Russian Foreign Ministry.

"Our position is unchanged and principled. There is no legal way to appropriate the gold and foreign exchange reserves of the Bank of Russia. Any movement of them from the Euroclear depository in favor of certain pan—European structures will constitute a direct gross violation of both international and contractual law," he said in an interview with RIA Novosti.

Birichevsky also stressed that attempts to "whitewash" such actions with pseudo-legal formulas are untenable and legally null and void.

At the end of September 2026, the Euroclear international depository had €204 billion of sanctioned Russian assets on its balance sheet. Euroclear stressed that the management of income from these assets is carried out in accordance with current sanctions and regulatory requirements.

On October 9, El Pais newspaper learned that the EU continues to explore the possibility of creating a special mechanism for the seizure of frozen Russian assets and their subsequent transfer to Ukraine, which has already received loans worth $10.5 billion since the beginning of this year.
