The court rejected the claim of Mirage Media against the production center of singer Sukhankina.

The Moscow Arbitration Court has completely dismissed the claim of Mirage Media LLC (representing the interests of the creator of the group Andrey Lityagin and owns the rights to the corresponding trademark to Mirage Music Production Center LLC for 5 million rubles. This is evidenced by the court's decision, which was reviewed by Izvestia on October 19.

As follows from the case file, Mirage Media demanded that the production center working with singer Margarita Sukhankina (ex-vocalist of the Mirage group) pay 5 million rubles in compensation and stop using the word "Mirage" in the brand name. The plaintiff motivated the claims by the fact that the defendant uses a confusingly similar designation when organizing concerts. In turn, representatives of the Mirage Music Production Center objected to the lawsuit, pointing to the fair use of the name.

The court, having studied the circumstances, sided with the defendant. The decision notes that the defendant's company was registered as a legal entity on January 20, 2017. At the same time, Mirage-Media LLC became the copyright holder of the disputed trademark No. 292970 only on May 24, 2022 (after the conclusion of the alienation agreement).

Thus, the defendant's right to the brand name arose more than five years earlier than the plaintiff acquired the trademark rights. As a result, the court decided to dismiss the defendant's motion to terminate the proceedings in the case, as well as to completely dismiss the claims of Mirage Media.

Composer Lityagin submitted an application to the Investigative Committee of the Russian Federation with a request to conduct an investigation into the ex-soloist of the group Sukhankina, after she spread slander about him in the media. Earlier, the singer, commenting on the Izvestia trial with Lityagin on the protection of copyrights to songs, said that the composer had been wanted for more than three years and was hiding from law enforcement agencies.
